Terms of Service

These Terms of Service ("Terms") are an agreement between you and David Cohen, the developer of Claim ("Claim", "we", "us"), covering your use of the Claim iPhone app and the claim-affirmations.com website (together, the "Service"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. What Claim is
Claim is a self-development tool. You choose apps to block, set a schedule, and unlock those apps by speaking your affirmations out loud. Claim uses Apple's Screen Time technology to apply the blocks you configure, and always includes an emergency unlock so you are never locked out of your own choices.
2. Claim is a commitment device, not a guarantee
Please use Claim thoughtfully:
- Blocking is under your control and can always be bypassed — through the emergency unlock, by changing iOS Screen Time permissions, or by deleting the app. Claim is a tool that helps you keep a promise to yourself; it cannot force you to.
- Do not block anything you might urgently need. While an app is blocked you may not be able to open it or act on its notifications. You are responsible for which apps you choose to block and when.
- Claim does not interfere with calls or emergency services. It shields apps you select; it does not block phone calls, SMS, or emergency dialing.
- Blocking may be interrupted. Operating-system changes, revoked permissions, device restores, or bugs can cause blocks to lift or fail to apply. We do not guarantee uninterrupted or error-free blocking.
3. Not professional advice
Affirmations and manifestation content in Claim are provided for motivation and self-development only. They are not medical, psychological, financial, or other professional advice, and we make no promises about outcomes — speaking affirmations does not guarantee any particular result in your life. Claim is not a substitute for treatment from a qualified professional. If you are struggling with your mental health, please seek professional help.
4. Eligibility and accounts
You must be at least 13 years old to use the Service, and old enough to enter into these Terms under the law where you live (or have a parent or guardian's consent). An account is optional; if you sign in with Apple, you are responsible for activity on your account. Our Privacy Policy explains what data an account stores and how to delete it.
5. Premium subscriptions
- Some features require a paid subscription ("Premium"). Prices and periods are shown in the app before you buy.
- Payment is charged to your Apple ID through the App Store. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
- You can manage or cancel any time in your Apple ID settings (apps.apple.com/account/subscriptions) or via Manage Subscription inside the app. Deleting the app does not cancel a subscription.
- Refunds are handled by Apple under App Store policies; we cannot issue App Store refunds ourselves.
- We may change Premium pricing or what is included; price changes apply only after notice, from your next renewal, and you can cancel before they take effect.
6. Your content
Affirmations you write are yours. If you sign in, you grant us a limited license to store, transmit, and back them up solely to operate the Service (for example, syncing them between your devices). Do not store content that is unlawful or that you have no right to use. We may remove content or suspend accounts that break this rule or abuse the Service.
7. License and acceptable use
We grant you a personal, non-exclusive, non-transferable license to use the app on Apple devices you own or control, as permitted by the App Store terms. You agree not to copy, modify, distribute, sell, or lease any part of the Service; not to reverse engineer the app except where the law permits it despite this clause; and not to abuse, overload, probe, or disrupt the Service or use it for anything unlawful.
8. Intellectual property
The Service — including the app, its design, built-in affirmation content, and the Claim name and logo — belongs to us or our licensors and is protected by intellectual-property laws. These Terms give you no rights to it except the license above.
9. Termination
You can stop using the Service at any time; you can delete your account in the app (Settings → Account → Delete Account). We may suspend or terminate your access if you materially breach these Terms or abuse the Service. Sections that by their nature should survive termination (such as disclaimers, liability limits, and governing law) survive.
10. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. Without limiting section 2, we do not warrant that the Service will be uninterrupted, error-free, or that blocking will always apply or lift as scheduled.
11. Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or opportunities, arising from your use of (or inability to use) the Service — including consequences of apps being blocked or not blocked. To the same extent, our total liability for all claims relating to the Service is limited to the amount you paid us in the 12 months before the claim arose (or US $20 if you paid nothing). Nothing in these Terms limits rights that consumer law gives you that cannot be limited by agreement.
12. App Store terms
These Terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for addressing any claims relating to it (including product liability, regulatory compliance, or intellectual-property claims). If the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price; Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You must also comply with the App Store Terms of Service when using the app.
13. Changes to these Terms
We may update these Terms as the Service evolves. We will post the updated Terms here and update the date above; for material changes we will give you notice in the app. Continuing to use the Service after changes take effect means you accept them.
14. Governing law
These Terms are governed by the laws of England and Wales, and disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales — except where the law of the country you live in gives you mandatory consumer protections or a right to sue locally, which these Terms do not take away.
